Terms of Service

Last updated: 7 October 2026

1. Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and Frictionary (“Frictionary,” “we,” “us”). By creating an account, running a test, or otherwise using the service, you agree to these Terms and to our Privacy Notice. If you do not agree, do not use the service.

You must be at least 18 and able to form a binding contract. If you use Frictionary for an organization, you represent that you are authorized to accept these Terms on its behalf, and “you” includes that organization.

2. What Frictionary is, and is not

Frictionary sends automated software agents through a website or product and reports where they succeed or struggle, with evidence, and optionally checks publicly observable signals about a site. It is a testing and diagnostic tool.

  • Findings are a sample of agent behavior at a point in time, generated in part by third-party AI models. They are evidence to investigate, not a guarantee, audit, certification, or professional, legal, or security advice.
  • AI-generated output (summaries, suggestions, fixes) may be incomplete or wrong. You are responsible for reviewing it before acting.
  • A passing result, score, or “Agent-Ready” mark does not warrant that your site is secure, compliant, accessible, or fit for any purpose.

3. Authorization to test, your responsibility

This is important. You may submit a site or product for testing onlyif you own it or have explicit authorization from its owner to test it. By submitting a target, you represent and warrant that you have that right, and you accept responsibility for the agents’ activity on that target.

Our agents are designed to observe and to verify that a task is reachable, they stop before irreversible actions and will not knowingly complete a purchase or payment, place or confirm an order, delete or deactivate anything, send messages, or submit real payment-card or credential data. Even so, automated interaction carries residual risk. We strongly recommend testing a staging or non-production environment, and you accept the risk of testing a live site. You are solely responsible for any consequence of tests you initiate.

4. Acceptable use

You will not, and will not permit anyone to:

  • test any system you do not own or lack authorization to test;
  • use the service to attack, overload, denial-of-service, circumvent security on, scrape at abusive volume, or gain unauthorized access to any system;
  • submit tasks intended to defraud, harass, infringe rights, or break the law;
  • probe, reverse-engineer, or disrupt Frictionary itself, or resell or share access except as your plan allows;
  • upload malware, or data you lack the right to provide.

Runs identify themselves honestly and are rate-limited. We may investigate and act on suspected misuse.

5. Accounts and security

You are responsible for your account, your credentials, your API keys, and all activity under them. Keep them secret, and tell us promptly at support@frictionary.ai of any unauthorized use. You are responsible for configuring budgets and limits appropriate to your spend tolerance.

6. Your content and data

You keep ownership of the sites, tasks, business profile, and other data you submit (“Customer Data”). You grant us a worldwide, non-exclusive license to host, process, and display it for the purpose of providing, securing, and improving the service, and as described in the Privacy Notice. For personal data you submit that is governed by data-protection law, we act as your processor and you as the controller; a Data Processing Addendum is available on request.

7. Plans, trials, billing, and taxes

Free trials are limited by usage. Paid plans and any prepaid balance are billed through our third-party payment processor on the terms shown at checkout. Fees are stated exclusive of taxes, which you are responsible for. Except where required by law, fees and prepaid amounts are non-refundable. We may change pricing for future periods with notice.

8. Intellectual property

Frictionary, including the software, models of presentation, reports’ structure, and marks, is owned by us and our licensors. We grant you a limited, revocable, non-transferable right to use the service per these Terms. You may use reports internally and share them as the product allows; you may not misrepresent a result or use our marks without permission.

9. Third-party services

The service relies on third parties (AI model providers, hosting, email/SMS, payments) listed in our Privacy Notice. Their availability and acts are outside our control, and your use may be subject to their terms. We are not liable for third-party services.

10. Disclaimer of warranties

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted or error-free, or that findings are complete or correct. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRICTIONARY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100. These limits do not apply to liability that cannot be excluded by law.

12. Indemnification

You will defend, indemnify, and hold harmless Frictionary from any claim, loss, or expense (including reasonable legal fees) arising from: (a) your use of the service; (b) your Customer Data; (c) your breach of the authorization-to-test warranty in Section 3; or (d) your breach of these Terms or violation of law or the rights of any third party.

13. Suspension and termination

You may stop using Frictionary at any time and delete your account, which deletes your Customer Data as described in the Privacy Notice. We may suspend or terminate access for breach of these Terms, suspected misuse, non-payment, or to protect the service or others. Sections that by their nature should survive termination (e.g., 6, 8, 10–12, 14) survive.

14. Governing law and disputes

These Terms are governed by the laws of [your state/country], without regard to conflict-of-laws rules, and the courts of [venue] have jurisdiction, except where mandatory local consumer law gives you other rights. [Placeholder, your attorney should set governing law, venue, and decide whether to include an arbitration/class-waiver clause, which has specific requirements in the US and limits in the EU/UK.]

15. Export, sanctions, and geographic availability

Frictionary is intended for users in the United States. We do not target or market the service to other regions, and we may restrict availability accordingly. If you access it from elsewhere, you do so on your own initiative and are responsible for complying with your local laws.

You may not use the service in violation of export-control or sanctions laws, and you represent you are not on a restricted-party list or in an embargoed region.

16. Changes

We may update these Terms. For material changes we will give notice (e.g., by email or in-app). Continued use after the change takes effect means you accept the updated Terms.

17. Miscellaneous

These Terms and the Privacy Notice are the entire agreement between us. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor. Neither party is liable for events beyond its reasonable control.
